GUARANTEE/DISCLAIMERS


We do all that we can to make sure that your order is prepared and decorated to the specifications of your order.  If for some reason something is not decorated correctly as stated on your order, we will make necessary changes right away.  Just let us know!


Every order is hand made. Decorative finishes are done by hand and are subject to the artistic interpretation of our expert decorators.  You may provide us with a photograph for inspiration and duplication; however, we make no claims for the exact duplication of the work done by other decorators. 


Creating any special orders always requires a lot of details and information to avoid any possible errors.  If you are trying to order a highly decorated cake over the phone, you should provide us with a sketch or picture (by email).  We would prefer to meet with you to discuss any special occasion cakes or products that may require intricate details.  There are a lot of chances that the design of your cake will be different than what you are expecting if not enough information is provided.  We will do our best to follow up with the appropriate amount of questions but assumptions will be made.  You must let us know exactly what you want.  If you don't tell us, we won't know.  


CAKE PICKUPS


  • Once you leave with your cake or order, it means that it is given to you in full and correctly.   If you are unhappy with your order, bring the matter to our attention before you leave.  Once you leave the bakery with your order, we cannot help you solve any issues.  
  • You will be asked to sign a waiver which states that the order was acceptable to your preference and, once you leave the bakery, the cake becomes your responsibility.  If someone else is picking up your order for you, they will sign for you that your order is acceptable to your preferences, so make sure they know what you are expecting.  The cake becomes your responsibility once it leaves the bakery, no matter who picks it up.  
  • All of our cakes, cupcakes, cookies and sweets are stored in a cooler at the bakery.  They will be cold when you pick them up or while in delivery as this allows for a better and safer transport.  We recommend you also store them in your refrigerator until about 2-3 hours prior to serving unless otherwise instructed.
  • All products are the client's responsibility upon leaving the bakery.  We are not responsible for any damage occurring to the cake during transport, set-up or any time thereafter.  The client assumes full responsibility arranging for the caterer/servers to cut, serve and remove all existing supports inside the cake.  All cake supports used are made of non-toxic products.  Sita's Sweets is not responsible for any injuries that may occur due to failure to remove the necessary supports.  Sita's Sweets is also not responsible for any damage the product may suffer due to the environmental conditions in which the cake or desserts are stored or displayed (location, temperature, weather, etc.).  An extended period without refrigeration will deteriorate the cake as well as the decorations.  Please handle your cake and treats with great care.
  • Keep in mind that cakes and perishable sweets are very fragile and damages can happen if not handled properly - such as cracks, smudges, melted frosting, collapse, etc.


                If you are not sure of the proper transport and care of your cake or baked good, please ask!



PICK UP NO SHOWS AND UNCLAIMED ORDERS


  • It is YOUR responsibility that you make arrangements to pick up your order on the day and at the time you have scheduled.  There will be NO REFUND made for any orders that were not picked up. 
  • We reserve the right to resell the items or donate them to the charity of our choice.  In cases in which a deposit was the only payment received, we will likely resell the items.  In an effort to give back to our community, ALL orders in which we received at least half of the total cost in advance, we will donate to a charity or shelter.  In some cases, when already paid for, we may store your purchase  in our freezer (if space allows) until the following business day, prior to donating, to allow you to pick up and enjoy.



SHIPPING


  • There is always a shipping charge, no matter where we are shipping. 
  • We ship flat rate 2 day delivery from the USPS.  You will be made aware of the fee for shipping at the time of your purchase and this will be added to your total as well as any taxes to be paid at the time of ordering. 
  • Orders are only shipped nationwide, using USPS  two day shipping on Monday, Tuesday and Wednesday to avoid weekend overlays.   Please contact us by 3pm CST Wednesday  if you would like an order shipped overnight air Thursday shipping, increased shipping fees will apply.
  • Shipments that are returned or require rerouting due to incorrect address will be subject to additional charges for reshipment and/or relabeling.
  • We are shipping baked goods that have no preservatives.  While we do ship second day delivery,  we  cannot guarantee our baked good's condition upon arrival.   By requesting shipping for your cake or treat, you are giving over the care of your product to the hands of others that aren't as loving with your purchase as you or we may be.  We do everything we can to pack your special treat to protect it from shipping bumps and bangs but we cannot be responsible for the condition of the package or contents when it arrives.  We also cannot be responsible for staleness/spoilage due to courier shipping delays or if the recipient is not at the delivery location to receive the shipment.  


DELIVERY


  • We take pride in our customer service which includes not only our products but also the reliability of delivery.  In order to ensure our quality of service, we require that any cancellations or adjustments to your order be made at least 7 days prior to your scheduled delivery date.  This will allow us to reschedule delivery routes and times for our delivery team.  
  • All deliveries can only be delivered between the hours of 7 am and 6 pm.
  • There is always a delivery charge, no matter where we are delivering. 
  • You will be aware of the amount of your delivery charge at the time of your purchase and is due at the time of purchase as well as any taxes.  
  • Your delivery fee does not include any tips for the delivery team if you should wish to make one.
  • We will set an estimated delivery time on the date you request, however, delivery times cannot be guaranteed.  Please know that we will strive to deliver by the time agreed upon to insure the quality of our products but unforeseen circumstances may cause a delivery to be slightly early or delayed.   If for some reason your delivery will be early or late, the delivery team will contact you by phone to let you know.
  • We cannot deliver to PO boxes.
  • A recipient's signature will be required for all deliveries to confirm delivery and acceptance of the product.  Please make sure someone is available for your deliveries in order to sign.  By signing, you accept the order is to your preference and once the delivery person leaves, the product becomes your responsibility.  
  • For deliveries to businesses or schools, the delivery person will wait at the front desk, with security or with the receptionist for your signature.  If the business location is closed at the time of delivery, please indicate so on your delivery request time and we will wait for you to receive your delivery outside your building at the time you request.
  • Should someone not be available to sign, this will be considered an unclaimed order (see above) and will be returned to the bakery.  Should you come to the bakery to pick up your order during the same day,  the delivery fee will not be refunded since delivery was attempted and the mileage/time expended.



SPECIAL NOTES ABOUT YOUR CAKE OR SITA'S SWEETS GOODIES:


  • If you are picking up your order, please drive carefully, keep cake lying flat in the car and in a cool climate.  DO NOT PLACE YOUR CAKE IN THE CAR SEAT! It is not level.  Doing so will cause the cake to slide and be damaged.  Keep in mind that  any sudden stops can result in the cake being tossed to the floorboard and ruined, even if in your lap.  
  • Florida summers get extremely humid and hot (summers anywhere for that matter); both being very hard on cakes, icings and fillings.  We keep all orders refrigerated and recommend that clients do the same, especially during hot summer months.  This will keep the cake cool and makes it much easer to transport without damage.  Sitting it out at room temperature for 30 minute will soften the icing back up.  If your order was shipped, bring it in immediately upon receiving, unpack it, and follow the directions provided in the box for storage.
  • DO NOT leave your cake or treat in the car while running other errands where you will have to leave your cake or treat in the car.  If the sun is out, the interior of your car is likely much warmer than that and the cake or treat WILL melt.
  • DO NOT place your cake or goodies on the counter near your stove and then use the stove to cook food!  Although keeping many types of cakes at room temperature is perfectly okay, the heat and/or moisture from the stove will cause the 'room' temperature to rise and the cake/frosting/treat to melt and fall apart. 
  • DO NOT place in a "sun-lit" area.  Even when left on a table or counter in a climate-cooled room.  If sitting in direct sunlight from a window, a cake or treat will get too warm and melt over time.
  • DO NOT (please do not, do not, do not) leave the cake or any cream filled or frosting decorated treats, fudge or butter mints  sitting outside for any length of time, even for a party.  It WILL melt.  It can melt in less than 20 minutes in higher temperatures.


Payment/Cancellation AND REFUND POLICIES

PAYMENT 


ALL SALES ARE FINAL,  NO EXCEPTIONS


  • Sita's Sweets accepts all major credit cards (MasterCard, Visa, Discover, American Express) as well as payment through Venmo and cash payments.
  • We require a 50% nonrefundable deposit/retainer to book any order for wedding or specialty cakes.  All other purchases are to be paid in full upon ordering before your order will be completed.
  • All orders that require delivery or shipping - payments must be made when ordered.  Any shipping or delivery order not paid in full (including shipping/delivery fees and taxes) at the time of ordering or if payment does not go through at the time of ordering will not be completed.  
  • Failure to make payment in full at the time of ordering will be interpreted as a cancellation request by you and your order will not be completed.   Should there be a problem with your payment not processing, we will contact you by phone so you can make alternative payment arrangements or cancel your order.



RETURN/REFUND POLICY


  • We promise to do our best to provide the best tasting and best looking treats and cakes to every client.   Every order is created with love by our talented staff just for you.  Please keep in mind that no two pieces of art made by people are ever exactly alike!  Every order is hand-made.  Decorative finishes are done by hand and are subject to the artistic interpretation by our bakery artists.  
  • If you are not entirely satisfied with your purchase we're here to help.  However, there can be no returns, refunds or exchanges accepted for perishable items unless an error has been made by us according to your order.  In the event that an error has been made with your order on our side, you must let us know prior to leaving the bakery or immediately upon delivery receipt and we will truly try our best to remedy the situation but there are no guarantees.   We will check your item to your order and definitely try to correct any mistakes on our part.   This, unfortunately does not apply to shipped items.  You have agreed, upon requesting your purchase be shipped, that the order is correct prior to shipping by confirming the email or text message that was sent to you with a picture of your purchase. 
  • We will ask you to make sure everything is correct such as the design, spelling, etc.  Refunds requested due to decorating style, writing, color shade or general design will not be honored after signing for your product.  In some instances, you may request a design adjustments but this is an additional charge if the cake has been signed for.  We can not stress enough to please make sure your cake or product is correct prior to signing.
  • If our error cannot be corrected,  and you refuse your order due to this error, we will provide you with a refund minus 25% (handling fee).  This refund will be given as a store credit (no cash/money refunds will be given).  If you receive a refund, you cannot keep the product.  You can only receive the store credit refund if you refuse to 'accept' the product otherwise payment in full is required.   We will not negotiate a partial refund if you keep the product.  This is a  'take the product or leave the product' policy.  We are not responsible for any expense you may incur to replace our product or cake. 
  • Cake, cookies, cupcakes and other sweets flavors and textures are subjective.  Full refunds requested due to flavor or texture after the cake has been accepted will not be honored.  You may qualify for a percentage of a store credit if the product is brought back and the quality of the product's flavor or texture does not meet our standards.  These products must be returned in a timely manner, preferably within 48 hours of receipt.  Please call or email us promptly to let us know of the issue.  Quality determination is solely at the discretion of Sita's Sweets.  Please understand that we cannot issue the refund (store credit) if the cake or items have been completely eaten or more than half of the item has been eaten.  Store credit percents are based on how quickly the item is returned, how much has been consumed and what we determine the quality to be.  Store credits of any kind will not be issued to customers who do not contact us within 24 hours and do not return the uneaten portion of the product in question.  You cannot send in a picture, the product must be returned.  We are not responsible for time or mileage required to return the uneaten product.



CANCELLATIONS- Before placing the order, ensure that you want to place the order as all sales are final with no exceptions.


  • For wedding cakes and specialty cakes, the 50% retainer/deposit is non-refundable and non-transferable as this secures your order and is retained as a booking fee.  All Sales are Final. No Exceptions.  Once the 50% deposit has been placed, this deposit will not be refunded.  
  • If canceled at least seven (7) days in advance, we will be happy to transfer any payment made on that order to another order within 3 months from that date.  We will provide no other refunds regardless of the circumstances.  You will be required to pay the full amount ( if not already paid) if the order is cancelled with less notice.  


POSTPONEMENT/CHANGES 


  • If you are in need of postponing your order to another date, please call the bakery directly - please DO NOT email.    This also must be within the seven (7) days time frame.   We do realize that 'things happen', we definitely do, but we do require a seven (7) days notice for any  postponements .  
  • Any changes that need to be made to your order must also be received prior to the seven (7) day deadline.  We are unable to make changes on orders after that time.  No refunds will be provided for any payments made on the order no matter the amount.
